Machine decision-making (artificial intelligence) in British Columbia’s government (Canada)

Jeremy Hainsworth’s September 19, 2023 article on the Vancouver is Awesome website was like a dash of cold water. I had no idea that plans for using AI (artificial intelligence) in municipal administration were so far advanced (although I did cover this AI development, “Predictive policing in Vancouver—the first jurisdiction in Canada to employ a machine learning system for property theft reduction” in a November 23, 2017 posting). From Hainsworth’s September 19, 2023 article, Note: A link has been removed,

Human discretion and the ability to follow decision-making must remain top of mind employing artificial intelligence (AI) to providing public services, Union of BC Municipalities conference delegates heard Sept. 19 [2023].

And, delegates heard from Office of the Ombudsperson of B.C. representatives, decisions made by machines must be fair and transparent.

“This is the way of the future — using AI systems for delivering municipal services,” Zoë Macmillan, office manager of investigations, health and local services.

The risk in getting it wrong on fairness and privacy issues, said Wendy Byrne, office consultation and training officer, is a loss of trust in government.

It’s an issue the office has addressed itself, due to the impacts automated decision-making could have on British Columbians, in terms of the fairness they receive around public services. The issue has been covered in a June 2021 report, Getting Ahead of the Curve [emphasis mine]. The work was done jointly with B.C.’s Office of the Information and Privacy Commissioner.

And, said office representatives, there also needs to be AI decision-making trails that can be audited when it comes to transparency in decision-making and for people appealing decisions made by machines.

She [Zoë Macmillan] said many B.C. communities are on the verge of implementing AI for providing citizens with services. In Vancouver and Kelowna, AI is already being used [emphasis mine] in some permitting systems.

The public, meanwhile, needs to be aware when an automated decision-making system is assisting them with an issue, she [Wendy Byrne] noted.

Message from the Officers

With the proliferation of instantaneous and personalized services increasingly being delivered to people in many areas in the private sector, the public is increasingly expecting the same approach when receiving government services. Artificial intelligence (AI) is touted as an effective, efficient and cost-saving solution to these growing expectations. However, ethical and legal concerns are being raised as governments in Canada and abroad are experimenting with AI technologies in
decision-making under inadequate regulation and, at times, in a less than transparent manner.

As public service oversight officials upholding the privacy and fairness rights of citizens, it is our responsibility to be closely acquainted with emerging issues that threaten those rights. There is no timelier an issue that intersects with our
respective mandates as privacy commissioners and ombudsman, than the increasing use of artificial intelligence by the governments and public bodies we oversee.

The digital era has brought swift and significant change to the delivery of public services. The benefits of providing the public with increasingly convenient and timely service has spurred a range of computer-based platforms, from digital assistants to automated systems of approval for a range of services – building permits, inmate releases, social assistance applications, and car insurance premiums [emphasis mine] to name a few. While this kind of machine-based service delivery was once narrowly applied in the public sector, the use of artificial intelligence by the public sector is gaining a stronger foothold in countries around the world, including here in Canada. As public bodies become larger and more complex, the perceived benefits of efficiency, accessibility and accuracy of algorithms to make decisions once made by humans, can be initially challenging to refute.

Fairness and privacy issues resulting from the use of AI are well documented, with many commercial facial recognition systems and assessment tools demonstrating bias and augmenting the ability to use personal information in ways that infringe
privacy interests. Similar privacy and fairness issues are raised by the use of AI in government. People often have no choice but to interact with government and the decisions of government can have serious, long-lasting impacts on our lives. A failure to consider how AI technologies create tension with the fairness and privacy obligations of democratic institutions poses risks for the public and undermines trust in government.

In examining examples of how these algorithms have been used in practice, this report demonstrates that there are serious legal and ethical concerns for public sector administrators. Key privacy concerns relate to the lack of transparency of closed proprietary systems that prove challenging to review, test and monitor. Current privacy laws do not contemplate the use of AI and as such lack obligations for key
imperatives around the collection and use of personal information in machine-based
systems. From a fairness perspective, the use of AI in the public sector challenges key pillars of administrative fairness. For example, how algorithmic decisions are made, explained, reviewed or appealed, and how bias is prevented all present challenging questions.

As the application of AI in public administration continues to gain momentum, the intent of this report is to provide both important context regarding the challenges AI presents in public sector decision-making, as well as practical recommendations that aim to set consistent parameters for transparency, accountability, legality and procedural fairness for AI’s use by public bodies. The critically important values of
privacy protection and administrative fairness cannot be left behind as the field of AI continues to evolve and these principles must be more expressly articulated in legislation, policy and applicable procedural applications moving forward.

This joint report urges governments to respect and fulfill fairness and privacy principles in their adoption of AI technologies. It builds on extensive literature on public sector AI by providing concrete, technology-sensitive, implementable guidance on building fairness and privacy into public sector AI. The report also recommends capacity-building, co-operation and public engagement initiatives government should undertake to promote the public’s trust and buy-in of AI.

This report pinpoints the persistent challenges with AI that merit attention from a fairness and privacy perspective; identifies where existing regulatory measures and instruments for administrative fairness and privacy protection in the age of AI fall short and where they need to be enhanced; and sets out detailed, implementable guidance on incorporating administrative fairness and privacy principles across the various stages of the AI lifecycle, from inception and design, to testing, implementation and mainstreaming.

The final chapter contains our recommendations for the development of a framework to facilitate the responsible use of AI systems by governments. Our recommendations include:

– The need for public authorities to make a public commitment to guiding principles for the use of AI that incorporate transparency, accountability, legality, procedural fairness and the protection of privacy. These principles should apply to all existing and new programs or activities, be included in any tendering documents by public authorities for third-party contracts or AI systems delivered by service providers, and be used to assess legacy projects so they are brought into compliance within a reasonable timeframe.

– The need for public authorities to notify an individual when an AI system is used to make a decision about them and describe to the individual in a way that is understandable how that system operates.

– Government promote capacity building, co-operation, and public engagement on AI.
This should be carried out through public education initiatives, building subject-matter knowledge and expertise on AI across government ministries, developing capacity to support knowledge sharing and expertise between government and AI developers and vendors, and establishing or growing the capacity to develop open-source, high-quality data sets for training and testing Automated Decision Systems (ADS).

– Requiring all public authorities to complete and submit an Artificial Intelligence Fairness and Privacy Impact Assessment (AIFPIA) for all existing and future AI programs for review by the relevant oversight body.

– Special rules or restrictions for the use of highly sensitive information by AI.

A bit startling to see how pervasive ” … automated systems of approval for a range of services – building permits, inmate releases, social assistance applications, and car insurance premiums …” are already. Not sure I’d call this 60 pp. report “Getting Ahead of the Curve” (PDF). It seems more like it was catching up—even in 2021.

277 – Science for Social Justice: Advancing the agenda set by the 2022 Cape Town World Science Forum

South Africa had hosted the 10th World Science Forum (WSF), a platform for global science policy dialogue, in Cape Town in December 2022. The WSF is co-organised by a partnership involving global science organisations including UNESCO, the AAAS and the International Science Council, and Hungarian Academy of Science. The theme of the 2022 WSF was “Science for Social Justice.” During a week of intense debate more than 3000 participants from across the world debated the role of science in advancing social justice. This session will review the outcomes of the Forum, including the WSF Declaration on Science for Social Justice.

910 – Canada’s Quantum potential : critical partnerships and public policy to advance Canada’s leadership in Quantum science and technology.

A few comments

I have highlighted speakers from two of the sessions as I’m going to make a few comments. Dr. Mona Nemer who’s part of the opening panel discussion and Canada’s Chief Science Advisor and Dr. Mehrdad Hariri, the founder and current Chief Executive Officer (CEO) for Canadian Science Policy Centre, which organizes the conference, are both from a region that is experiencing war.

I imagine this is a particularly difficult time for many people in Canada whose family and friends are from the various communities in that region. Along with many others, I hope one day there is peace for everyone. For anyone who might want a little insight into the issues, there’s an October 15, 2023 CBC (Canadian Broadcasting Corporation) radio programme segement on ‘The Sunday Magazine with Piya Chattopadhyay’,

How to maintain solidarity in Canadian Jewish and Palestinian communities

The events in Israel and Gaza in the last week have sparked high levels of grief, pain and outrage, deepening long-simmering divides in the region and closer to home. For years, Raja Khouri and Jeffrey Wilkinson have embarked on a joint project to bring North American Palestinian and Jewish communities together. They join Piya Chattopadhyay to discuss how the events of the last week are challenging that ongoing mission in Canada… and how to strive for solidarity in a time of grief and trauma.

You can find the almost 22 mins. programme here. Khouri’s and Wilkinson’s book, “The Wall Between: What Jews and Palestinians Don’t Want to Know about Each Other” was published on October 3, 2023 just days before the initial Hamas attacks,

The Wall Between is a book about the wall that exists between Jewish and Palestinian communities in the Diaspora. Distrust, enmity, and hate are common currencies. They manifest at university campuses, schools and school boards, at political events, on social media, and in academic circles. For Jews, Israel must exist; for Palestinians, the historic injustice being committed since 1948 must be reversed. Neither wants to know why the Other cannot budge on these issues. The wall is up.

These responses emanate, primarily, from the two “metanarratives” of Jews and Palestinians: the Holocaust and the Nakba. Virtually every response to the struggle, from a member of either community, can be traced back to issues of identity, trauma, and victimhood as they relate to their respective metanarrative. This book examines the role that propaganda and disinformation play in cementing trauma-induced fears for the purpose of making the task of humanizing and acknowledging the Other not just difficult, but almost inconceivable. The authors utilize recent cognitive research on the psychological and social barriers that keep Jews and Palestinians in their camps, walled off from each other. They present a clear way through, one that is justice-centered, rather than trauma-and propaganda-driven.

The authors have lived these principles and traveled this journey, away from their tribal traumas, through embracing the principles of justice. They insist that commitment to the Other means grappling with seemingly incompatible narratives until shared values are decided and acted upon. This book is a call to justice that challenges the status quo of Zionism while at the same time dealing directly with the complex histories that have created the situation today. The book is both realistic and hopeful—a guide for anyone who is open to new possibilities within the Israel-Palestine discourse in the West.

From the publisher’s author descriptions, “Jeffrey J. Wilkinson, PhD, is an American Jew who lives in Canada.” From his Wikipedia entry, “Raja G. Khouri is a Lebanese born Arab-Canadian..”

Also, thank you to Dr. Nemer and Dr. Hariri for the science policy work they’ve done here in Canada and their efforts to expand our discussions.

On a much lighter note, the ‘quantum session’ panel is dominated by academics from the University of Ottawa, a policy wonk from Ottawa, and a representative from a company based in Toronto (approximately 450 km from Ottawa by road). Couldn’t the panel organizers have made some effort to widen geographical representation? This seems particularly odd since the policy wonk (Jeff Kinder) is currently working with the Canadian Council of Academies’ Expert Panel on the Responsible Adoption of Quantum Technologies, which does have wider geographical representation.

This CSPC 2023 panel also seems to be another example of what appears to be a kind of rivalry between D-Wave Systems (based in the Vancouver area) and Xanadu Quantum Technologies (Toronto-based) or perhaps another east-west Canada rivalry. See my May 4, 2021 posting (scroll down to the ‘National Quantum Strategy’ subhead) for an overview of sorts of the seeming rivalry; there’s my July 26, 2022 posting for speculation about Canada’s quantum scene and what appears to be an east/west divide; and for a very brief comment in my April 17, 2023 posting (scroll down to the ‘The quantum crew’ subhead.)

There’s a preliminary list of speakers available according to my July 20, 2023 announcement received via email. At this point the list is heavily tilted to speakers from health and agriculture/food agencies.

There are a few international speakers, one from the UK (she’s from the University of Sheffield and their Food Standards Agency) and two from France (ambassador to Canada, Michel Miraillet) and a representative from the French Ministry of Higher Education and Research.

The 15th Canadian Science Policy Conference (CSPC 2023), will be held in person on November 13th – 15th, 2023. The conference expects 1000+ participants, more than 300 speakers, in 60 panel sessions. CSPC 2022 will also include a spectacular Gala dinner featuring its award ceremony which has become a signature annual event to celebrate Canadian science and innovation policy achievements.

Nice to see interest in the Indo-Pacific region. Unsurprisingly given that these discussions are dominated by policy wonks from central and eastern Canada (heavily dominated by Ontario), Europe is mentioned first.

Regarding the call, I have more information from the CSPC 2023 Panel Proposal Criteria webpage, Note: I have made some formatting changes,

1.Submission type: There are two types of submissions;

a) Panel proposals (CSPC 2023 Overarching Theme, Tracks, and Topics)

80 minute panels (50 minute presentation, 30 minutes for Q&A session) where a diverse, multisectoral group discusses topics in science policy (see CSPC 2023 Overarching Theme, Tracks, and Topics)

b) Short talk proposals. (maximum 12 submissions will be accepted)

10 minute presentations (8 minute presentation, 2 minutes for Q&A session) that are intended to provide a brief overview of a topic in science policy.

3. CSPC 2023 will be an in-Person Conference: To participate in the in-person conference between Nov-13-15, 2023, at Westin Hotel Ottawa, Ontario, panelists must be present on-site. (In exceptional cases, we will try to accommodate virtual attendance for select speakers).

4. There is NO fee associated with proposal submission. However, CSPC is not responsible for speakers’ travel and accommodation costs. Speakers are entitled to register at a discounted rate.

5. Panel Diversity: CSPC is a national forum and mosaic that is built upon a balanced representation of diversity including region, sector, ethnicity, gender, age, and topic, in addition to seeking to provide under-represented groups an opportunity to present their ideas. These criteria will be heavily considered in the final selection of panels.

6. The Program Committee, alongside external reviewers from the community, will make selections based on the following criteria.

Proposals will be ranked based on the following high level criteria:

Quality of the proposed session: proposal description and justification (35%)

An action and/or solution-oriented focus, as opposed to a statement of the status quo of an issue (15%)

A diverse range of panelists (20%)

Quality of the speakers and moderator (15%)

Full Description of Criteria

1. Quality of the proposed session: proposal description and justification (35%)

The Quality of the session is evaluated on the panel description and justification:

Deep comprehension of the issue

Clear and compelling description of the panel and its novelty and importance to, and impact on, society

The value of the panel to be discussed at CSPC, in terms of follow ups, calls to action, policy change, etc.

Alignment with the Conference theme and topics

2. Incorporation of an action and/or solution-oriented focus, as opposed to a statement of the status quo of an issue (15%)

CSPC is seeking sessions that focus on solutions, forward actions and a futuristics analysis, rather than just a reiteration of the status quo.
