Corporate influence, nanotechnology regulation, and Friends of the Earth (FoE) Australia

The latest issue of the newsletter, Chain Reaction # 121, July 2014, published by Friends of the Earth (FoE) Australia features an article by Louise Sales ‘Corporate influence over nanotechnology regulation‘ that has given me pause. From the Sales article,

I recently attended an Organisation for Economic Co-operation and Development (OECD) seminar on the risk assessment and risk management of nanomaterials. This was an eye-opening experience that graphically illustrated the extent of corporate influence over nanotechnology regulation globally. Representatives of the chemical companies DuPont and Evonik; the Nanotechnology Industries Association; and the Business and Industry Advisory Committee to the OECD (BIAC) sat alongside representatives of countries such as Australia, the US and Canada and were given equal speaking time.

BIAC gave a presentation on their work with the Canadian and United States Governments to harmonise nanotechnology regulation between the two countries. [US-Canada Regulatory Cooperative Council] [emphasis mine] Repeated reference to the involvement of ‘stakeholders’ prompted me to ask if any NGOs [nongovernmental organizations] were involved in the process. Only in the earlier stages apparently − ‘stakeholders’ basically meant industry.

A representative of the Nanotechnology Industries Association told us about the European NANoREG project they are leading in collaboration with regulators, industry and scientists. This is intended to ‘develop … new testing strategies adapted to innovation requirements’ and to ‘establish a close collaboration among authorities, industry and science leading to efficient and practically applicable risk management approaches’. In other words industry will be helping write the rules.

Interestingly, when I raised concerns about this profound intertwining of government and industry with one of the other NGO representatives they seemed almost dismissive of my concerns. I got the impression that most of the parties concerned thought that this was just the ‘way things were’. As under-resourced regulators struggle with the regulatory challenges posed by nanotechnology − the offer of industry assistance is probably very appealing. And from the rhetoric at the meeting one could be forgiven for thinking that their objectives are very similar − to ensure that their products are safe. Right? Wrong.

I just published an update about the US-Canada Regulatory Cooperation Council (RCC; in  my July 14, 2014 posting) where I noted the RCC has completed its work and final reports are due later this summer. Nowhere in any of the notices is there mention of BIAC’s contribution (whatever it might have been) to this endeavour.

Interestingly. BIAC is not an OECD committee but a separate organization as per its About us page,

BIAC is an independent international business association devoted to advising government policymakers at OECD and related fora on the many diversified issues of globalisation and the world economy.

Officially recognised since its founding in 1962 as being representative of the OECD business community, BIAC promotes the interests of business by engaging, understanding and advising policy makers on a broad range of issues with the overarching objectives of:

  • Positively influencing the direction of OECD policy initiatives;

  • Ensuring business and industry needs are adequately addressed in OECD policy decision instruments (policy advocacy), which influence national legislation;

  • Providing members with timely information on OECD policies and their implications for business and industry.

Through its 38 policy groups, which cover the major aspects of OECD work most relevant to business, BIAC members participate in meetings, global forums and consultations with OECD leadership, government delegates, committees and working groups.

I don’t see any mention of safety either in the excerpt or elsewhere on their About us page.

As Sales notes in her article,

Ultimately corporations have one primary driver and that’s increasing their bottom line.

I do wonder why there doesn’t seem to have been any transparency regarding BIAC’s involvement with the RCC and why no NGOs (according to Sales) were included as stakeholders.

While I sometimes find FoE and its fellow civil society groups a bit shrill and over-vehement at times, It never does to get too complacent. For example, who would have thought that General Motors would ignore safety issues (there were car crashes and fatalities as a consequence) over the apparently miniscule cost of changing an ignition switch. From What is the timeline of the GM recall scandal? on Vox.com,

March 2005: A GM project engineering manager closed the investigation into the faulty switches, noting that they were too costly to fix. In his words: “lead time for all solutions is too long” and “the tooling cost and piece price are too high.” Later emails unearthed by Reuters suggested that the fix would have cost GM 90 cents per car. [emphasis mine]

March 2007: Safety regulators inform GM of the death of Amber Rose, who crashed her Chevrolet Cobalt in 2005 after the ignition switch shut down the car’s electrical system and air bags failed to deploy. Neither the company nor regulators open an investigation.

End of 2013: GM determines that the faulty ignition switch is to blame for at least 31 crashes and 13 deaths.

According to a July 17, 2014 news item on CBC (Canadian Broadcasting Corporation) news online, Mary Barra, CEO of General Motors, has testified on the mater before the US Senate for a 2nd time, this year,

A U.S. Senate panel posed questions to a new set of key players Thursday [July 17, 2014] as it delves deeper into General Motors’ delayed recall of millions of small cars.

An internal report found GM attorneys signed settlements with the families of crash victims but didn’t tell engineers or top executives about mounting problems with ignition switches. It also found that GM’s legal staff acted without urgency.

GM says faulty ignition switches were responsible for at least 13 deaths. It took the company 11 years to recall the cars.

Barra will certainly be asked about how she’s changing a corporate culture that allowed a defect with ignition switches to remain hidden from the car-buying public for 11 years. It will be Barra’s second time testifying before the panel.

The Nanotechnology Industries Association (NIA) has announced a very nifty-sounding database, from the Nov. 4, 2013 news item on Nanowerk (Note: A link has been removed),

The Nanotechnology Industries Association (NIA) today launched its Regulatory Monitoring Database (you need to be a registered NIA member to access the database). This Database is a comprehensive tool that allows its users to monitor nano-specific regulations and standards around the world.

Here’s more from the Nov. 4, 2013 NIA news release, which originated the news item,

As legislative texts across the globe increasingly include provisions related to nanotechnologies, it is becoming ever more crucial for businesses to understand and anticipate both what policy-makers are developing, and what standards could apply to them. NIA’s Regulatory Monitoring Database sets out to improve its users’ understanding of these and aid them in taking the appropriate courses of action for their businesses.

Colour-coded so as to be easy-to-use and simple to navigate, the Database informs users of the latest developments, their importance and their expected impact. Specially-tailored Analysis Pages are also made for each item, and information about key actors, main dates, nano-relevant quotes from the text, and the history of the development are also provided.

As anyone who’s been following the regulatory scene will tell you, this cannot have been a small project to start and I imagine maintenance is going to be expensive, so, there is a cost associated with access to the database, from the news release,

Non-NIA Members are invited to subscribe to this new service. Access to the database is provided free of charge to NIA Corporate and Associate Members, while NIA Affiliate Members are eligible for a discount on the fee equal to the cost of their annual membership fee.

Given that the NIA has offices in Brussels (Belgium), Lisbon (Portugal), and London (UK),, this effort might be seen as Eurocentric. The video never does mention any specific jurisdictions. Personally and despite the claim that the database is a “comprehensive tool that allows its users to monitor nano-specific regulations and standards around the world,” I’m curious as to how much information they have about regulations in  China, Japan, India, and other places outside Europe and from linguistic families not found there.

Through NIA’s constant involvement in a number of international organisations, members of the Nanotechnology Industries Association are represented on globally influential fora, such the OECD Working Party on Manufactured Nanomaterials, and the OECD Working Party on Nanotechnology, as well as national and international advisory groups and standardisation committees, such as ISO/TC 229 and CEN/TC 352.

Nanotechnology for Green Innovation report, Canada, and the OECD’s Working Party on Manufactured Nanomaterials

I will get to the report in a moment but since it led me on a magical mystery tour through the OECD (Organization for Economic Cooperation and Development) and its new website and assorted organizational confusions, I thought I’d share those first.

February 2012 marks the last report from the OECD’s Working Party on Manufactured Nanomaterials that I can find. As well, the OECD appears to have changed its website recently (since Feb. 2012) and I find searching it less rewarding.

There’s more, it seems that the Working Party on Manufactured Nanomaterials either no longer exists or has been subsumed as part of the Working Party on Nanotechnology. I mourn the old nanomaterials working party as I found much valuable information there about the Canadian situation that was available nowhere else. Oddly, Industry Canada still has a webpage devoted to the OECD’s Working Party on Manufactured Nanomaterials but the OECD link on the Industry Canada leads you to a database,

The OECD Working Party on Manufactured Nanomaterials (WPMN ) was established in September, 2006 in order to foster international co-operation in health and environmental safety-related aspects of manufactured nanomaterials. Environment Canada represents the Government of Canada at the WPMN, supported by other interested federal departments and agencies, including Industry Canada, and stakeholders. For more information on the work of the WPMN, please visit the WPMN website or contact Environment Canada.

A new ‘green’ nanotechnology and innovation report was announced in a June 18, 2013 news item on Nanowerk (Note: A link has been removed),

A new paper by the OECD Working Party on Nanotechnology (“Nanotechnology for Green Innovation”; pdf) brings together information collected through discussions and projects undertaken relevant to the development and use of nanotechnology for green innovation. It relies in particular on preliminary results from the WPN project on the Responsible Development of Nanotechnology and on conclusions from a symposium, organised by the OECD WPN together with the United States National Nanotechnology Initiative, which took place in March 2012 in Washington DC, United States, on Assessing the Economic Impact of Nanotechnology. [emphases mine]  It also draws on material from the four background papers that were developed for the symposium. The background papers were:

“Challenges for Governments in Evaluating the Return on Investment from Nanotechnology and its Broader Economic Impact” by Eleanor O’Rourke and Mark Morrison of the Institute of Nanotechnology, United Kingdom;

“Finance and Investor Models in Nanotechnology” by Tom Crawley, Pekka Koponen, Lauri Tolvas and Terhi Marttila of Spinverse, Finland;

“The Economic Contributions of Nanotechnology to Green and Sustainable Growth” by Philip Shapira and Jan Youtie, Georgia Institute of Technology, Atlanta, United States; and

“Models, Tool and Metrics Available to Assess the Economic Impact of Nanotechnology” by Katherine Bojczuk and Ben Walsh of Oakdene Hollins, United Kingdom.

The purpose of the paper is to provide background information for future work by the WPN on the application of nanotechnology to green innovation.

I wrote about the March 2012 symposium in a March 29, 2012 posting,

I was hoping for a bit more detail about how one would go about including nanotechnology-enabled products in this type of economic impact assessment but this is all I could find (from the news release),

In their paper, Youtie and Shapira cite several examples of green nanotechnology, discuss the potential impacts of the technology, and review forecasts that have been made.

I checked both Philip Shapira‘s webpage and Jan Youtie‘s at Georgia Tech to find that neither lists this latest work, which hopefully includes additional detail. I’m hopeful there’ll be a document published in the proceedings for this symposium and access will be possible.

So, I’m very happy to see this 2013 report and  I have three different ways to access it,

The following comments are based on a very quick read through the report. Pulling together four papers and trying to create a cohesive and coherent single report after the fact is difficult and this report shows some of the stresses. One  of the problems is that 34 or 35 pp., depending on which version you’re reading, isn’t enough to cover the very broad topic indicated by the report’s title. I couldn’t find a clear general statement about government policies. For example, there are various countries with policies and there are trade blocks such as the European Union which also has policies. Additionally, there may be other jurisdictions. All of which contribute an environment which makes ‘green’ innovation nano or otherwise a challenge but no mention is made of this challenge. Further, I don’t recall seeing any mention of patents, which I’d expect would be a major talking point in a paper with innovation in its title. If there was mention of intellectual property, it made no impact on me, odd, especially where nanotechnology is concerned.

The report does have some good specifics and  it is worthwhile reading. For example, I found the section on lithium-ion batteries quite informative.

In any event, I’m not really the audience for this document, the “purpose of the paper is to provide background information for future work by the WPN on the application of nanotechnology to green innovation.”
